Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and QUIZINC (“QUIZINC”, “we”, “us” or “our”). They govern your use of our website (the “Site”) and any game we develop and publish, including updates and in-game content (our “Games”). Together, the Site and Games are the “Services”.

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility and young players

Our Games are made for everyone. If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.

2. Third-party platforms

Our Games are distributed through third-party platforms such as Poki. When you play a Game on a platform, you must also follow that platform's terms of use and policies. The platform is responsible for its own service, including advertising, accounts, and availability. These Terms apply in addition to the platform's terms. If they conflict about the platform's service, the platform's terms prevail; if they conflict about our Games and content, these Terms prevail.

3. Your licence to play

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and play our Games for your own personal, non-commercial entertainment, on the platforms where we have published them.

The Games are licensed to you, not sold. We and our licensors keep all rights not expressly granted to you.

4. Rules of play

When using the Services, you agree not to:

• copy, download, re-host, mirror, embed, frame, or redistribute our Games or their assets on any website, app, or service that we have not authorised;
• sell, rent, lease, or otherwise commercially exploit the Games, except as allowed in Section 6;
• decompile, disassemble, reverse engineer, or attempt to extract the source code or assets of the Games, except where the law expressly allows it;
• use cheats, exploits, bots, automation software, hacks, or any unauthorised third-party software that modifies the Games or gives an unfair advantage;
• interfere with, disrupt, overload, or attempt to gain unauthorised access to the Services or the systems that run them;
• remove, alter, or hide any copyright, trademark, or other proprietary notices; or
• use the Services for any unlawful purpose or in a way that harms other players, us, or anyone else.

5. Intellectual property

The Services, including all game code, artwork, characters, music, sound effects, text, logos, and the QUIZINC name, are owned by QUIZINC or our licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any of those rights to you.

6. Videos, streams and fan content

We love seeing people play our Games! You may record and share gameplay videos, livestreams, screenshots, and fan art of our Games on platforms like YouTube and Twitch, and you may monetise those videos through the platform's standard partner programmes, provided that:

• your content includes meaningful gameplay or commentary, not just our raw assets, music, or trailers;
• you do not suggest that your content is official or endorsed by QUIZINC; and
• you do not use our content in anything hateful, unlawful, or otherwise harmful.

We may withdraw this permission for any specific content at our discretion.

7. In-game items and progress

Our Games may include in-game currencies, items, unlockables, scores, or leaderboards (“Virtual Items”). Virtual Items have no monetary value, cannot be exchanged for real money or anything of value, and are licensed to you only as part of the Games. Game progress is usually stored in your browser on your device, so it may be lost if you clear your browser data, switch devices, or if a Game is updated. We are not responsible for lost progress or Virtual Items.

8. Advertising

Our Games may show advertisements, which are provided and controlled by the platform on which you play. We are not responsible for the content of third-party ads or for any products or services they promote.

9. Feedback

If you send us ideas, suggestions, or other feedback about the Services, you agree that we may use it freely, without any obligation or payment to you.

10. Changes and availability

We are always tinkering. We may update, change, suspend, or discontinue any part of the Services, including any Game or feature, at any time and without notice. We do not guarantee that the Services will always be available, uninterrupted, or error-free.

11. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QUIZINC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. BECAUSE OUR GAMES ARE FREE TO PLAY, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED FIFTY US DOLLARS (US $50).

Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law, or excludes liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless QUIZINC from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

14. Termination

We may suspend or end your right to use the Services at any time if you break these Terms. You may stop using the Services at any time. Sections 5, 7, 9, and 11 to 17 survive termination.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved in the courts of England and Wales, unless the mandatory consumer protection laws of your country of residence give you the right to bring a claim in your local courts.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your continued use of the Services after an update means you accept the new Terms.

17. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition, or sale of assets.
